This is meant as a brief general guide to the act and in no way is a valid legal opinion –please consult with either the Department of Internal Affairs or your lawyer.

In brief the Unsolicited Electronic Messages Act 2007 has four key areas of compliance:

  1. A unsolicited commercial electronic message that has a New Zealand link must not be sent unless the receiver has first consented to receiving the message;
  2. All commercial electronic messages must include a “functional unsubscribe facility” which allows the recipient to inform the sender that such messages should not be sent to them in the future;
  3. All commercial electronic messages must include information which clearly identifies the person who authorises sending the message and how that person can be contacted;
  4. “Address–harvesting software” must not be used in connection with, or with the intention of, sending unsolicited commercial electronic messages. “Address harvesting software” is software that searches the Internet for electronic addresses and collects and compiles those addresses.

Who does the Act apply to?
The Act applies to either an individual who is physically present in New Zealand at the time of the use or an organisation that carries on business or activities in New Zealand.

What electronic messages does this Act apply to?
For the purposes of this Act, an electronic message has a New Zealand link if one or more of the following applies:

  1. The message originates in New Zealand,
  2. The person who sent the message is an individual who is physically present in New Zealand when the message is sent; or an organisation whose central management and control is in New Zealand when the message is sent
  3. The computer, server, or device that is used to access the message is located in New Zealand
  4. The recipient is an individual who is physically present in New Zealand when the message is accessed; or an organisation that carries on business or activities in New Zealand when the message is accessed
  5. If the message cannot be delivered because the relevant electronic address does not exist, assuming that the electronic address existed, it is reasonably likely that the message would have been accessed using a computer, server, or device located in New Zealand.
  6. If it is sent to an electronic address that ends with “.nz”

Contact us! All our users must abide by our ACCEPTABLE USE POLICY which specifically forbids spamming. We will take all reasonable steps to determine the senders and ensure that it does not reoccur. However please note that the Act states “A service provider does not send an electronic message, or cause an electronic message to be sent, or contravene Section 15, merely because the service provider provides a telecommunications service that enables an electronic message to be sent.”

Anti-Spam enforcement

The Department of Internal Affairs will enforce the Unsolicited Electronic Messages Act 2007 by:

  • Investigating complaints about spam
  • Acting against ‘spammers’ who are deliberately flouting the law
  • Undertaking research into technologies used to send spam
  • Advising Government and organisations on spam matters
  • Liaising with relevant overseas bodies to ensure New Zealand complies with international agreements concerning spam.

Businesses and individuals are able to lay complaints about spam with the ‘Anti-Spam Compliance Unit’. The Department may investigate these complaints and take the appropriate action.

Wasp NZ uses One Fibre for our voice services, you will need an internet connection to use our VoIP solution. One Fibre is one of the most respected VoIP service providers in NZ and they are 100% NZ owned. Wasp provides limited support and cannot be held accountable for phone line issues however Wasp will check the quality of their internet service before any support requested is lodged with Onefibre.

Installation Costs: $131.00
Porting Fee: $5.00
New number $7.00

The installation cost of $49.00 charged by Wasp covers one ATA (phone router) located on site at the customers request. (City limits only).  The porting charge of $5.00 applies when transferring an existing number. If a new number is generated then a $7.00 charge applies.

The installation cost quoted is for one visit only. If we have to return due to customer circumstances (no credit card available, not home, no credit available, faulty home wiring etc) we will charge for additional labour and mileage.

Number Porting (moving your existing number from your current provider to One Fibre) can take up to 10 working days.  Potential disruption to your phone service can be up to 2 days (sometimes longer) is to be expected especially for unforeseen circumstances.

Our VoIP service generally won't work with satellite, and some TV receivers, this may prevent you making pay per view purchases.

While Wasp takes every effort via our internet service to ensure voice quality and phone reliability we cannot be held responsible for phone call performance. Where ADSL and VDSL connections are used WASP is not responsible for your household / business wiring, if there are any problems this is the client's responsibility to resolve. (note ADSL is a best effort services and is subject to quality of service issues when the network is under load)

The existing analogue phone can be used however we strongly advise a new cordless digital phone be used in the home environment with matching slave phone.  VoIP will not work without an internet connection, if there is a power cut you will lose both phone and internet service.

You are required to pay on the 20th of every month for the service. Wasp reserves the right to switch off the internet and VoIP service if payment has not been received within 8 days of the invoice due date. All invoices will be emailed.

Monitoring Services

Locating services used by Emergency Services may not work with VoIP; you may have to inform Emergency Services of your address when calling.

If you have a monitored alarm or medical alarm it will need to be kept on an analogue line or via Chubb Security using the latest RadioNet service. Speak to your security provider for advice on IP as well. – additional charges may apply

The ATA (VoIP) router that Wasp supplies has two phone ports, only the numbers noted in the 'Phone Number' section will be ported, if you have other numbers/other lines please ensure to include these also, otherwise they will be disconnected.

Wasp NZ will not be held accountable for losses or inconvenience caused by VoIP phone line operation. The client understands that they must deal with Wasp in the first instance with regards to account enquiries and faults. We do not recommend this service for those without phone redundancy or for those that rely on 24/7 fixed phone operation.
